CYPRESS, TX – Jeremy Porter will remain held without bond after a judge found probable cause during his initial hearing on a capital murder charge in the shooting death of 5-year-old Zah’Layah Walton.

Harris County District Attorney Sean Teare discussed the hearing during a press conference outside the courtroom. Teare said prosecutors notified the court that they intend to seek an order keeping Porter held without bond while the case is pending.

A detention hearing is expected in about 10 days. Teare said prosecutors will present evidence concerning whether Porter poses a continuing danger to the community, whether he is a flight risk and other factors for the judge to consider.

Teare said the case remains in its early stages and investigators are examining every circumstance that placed the two vehicles next to each other on Grant Road.

Teare declined to speculate about Porter’s account of the shooting. He said investigators currently believe a projectile was fired from inside Porter’s truck, but ballistics testing had not been completed and the truck had not been fully processed.

Teare credited the Harris County Sheriff’s Office and prosecutors with identifying and arresting Porter within 24 hours. He called Flock cameras an essential crime-fighting tool while also saying the technology needs safeguards and regulation.

LaBoshea Hendry, director of victim services for No More Victims and Legends and Legacies, spoke on behalf of Walton’s family. Hendry thanked investigators for acting quickly and condemned the use of gunfire during road rage incidents.

Hendry said someone facing a dangerous situation should call 911 instead of pulling a weapon. She said Walton’s life mattered and the family would continue seeking justice.

Hendry also asked the public to allow investigators to gather the facts and avoid trying the case through social media.

The case stems from a shooting shortly before midnight Sept. 19 as Walton’s mother drove westbound on Grant Road from Jones Road with five children younger than 10 inside her vehicle. Walton was shot in the head and flown to Memorial Hermann Hospital, where she was pronounced deceased. Two other children were injured by shattered glass.

According to court documents, investigators used Flock cameras to locate a white Ford pickup allegedly involved in the shooting. After being advised of his rights, Porter allegedly admitted he was driving the truck and fired five rounds toward another vehicle that he claimed had fired at him and was being driven erratically.
