Murder charge accepted against Baytown man in fatal shooting of Rocky Modica

BAYTOWN, Texas — The Harris County District Attorney’s Office has accepted a murder charge against Joel Garza, 64, of Baytown, in connection with a fatal shooting on South Pruett Street, according to the Baytown Police Department.

Police identified the victim as Rocky Modica, 45, also of Baytown. Garza has been arrested.

The shooting occurred in the 1500 block of South Pruett Street, near West Nazro and West Main streets. Preliminary information indicates the men knew each other and were arguing before one allegedly pulled out a firearm and shot the other, police said.

A witness who requested to remain anonymous previously said he encountered the victim at a nearby corner store shortly before the shooting. The witness said the victim described an earlier altercation and feared the other man was still nearby.

According to the witness, the suspect put on earmuffs and stood in the roadway before shooting the victim from behind as he rode past on a bicycle. The witness said the victim fell off the bicycle and tried to run across the street, but the suspect continued firing.

The witness reported hearing several gunshots. He also said someone moved the bicycle afterward and that the suspect placed a cloth on his head while claiming he had been assaulted.

Those witness details have not been confirmed by police.

The investigation remains ongoing.
